On top of that, a motion for rehearing is really, really disfavored. Unless the HOA found new evidence or a new, seminal case came out that substantively changes the law (both highly unlikely), the motion will be denied and the case will go back down to the trial court. 

 

The good news is that if and when the case goes down to the trial court level, the HOA will begin incurring some fees (appellate work tends to have caps on the amount of work that's required). While this isn't a factually intensive case, there nevertheless are going to be some fees incurred by the HOA particularly given the law firms representing it. Also, because this is a dec action -- the majority of issues will be decided as a matter of law for the court as opposed to the jury -- you could see quicker movement despite the district court's current backlog.

The Motion for Rehearing at SCOTX has not yet been decided. However, given SCOTX’s favorable opinion and the general unlikelihood the motion for rehearing will be granted, it is possible the developer may have let the mattress store’s lease run out to move as soon as possible after the final ruling.

I'd also point out that several of the largest units in the building are on the market (check HAR).  Also, while the Post Oak project has started working on literally every single piece of sidewalk down the street... they have not started any work / planted any trees / done any improvements on the portion that falls within this property.  Makes me bullish that the project is on deck.

This design seems like an excellent 2007 period piece. I like it, but it doesn't feel super contemporary. The saving grace is the treatment of the ground floor and parking podium, which would not have happened like this anywhere in Texas in 2007.

 

Also - is this the first development that emphatically states that Post Oak Blvd. will be walkable? BLVD Place came close but chickened out and put in a row of parking.

Not really in feel. 

Too much car traffic.

Maybe if they ever get the Post Oak and University line running; continuous spacious side walks on both sides and well landscape.

 

Otherwise it will be nice to gaze upon from a far but not so pleasant to be out on.

 

Clean up Main street square, throw in some stores and restaurants and it will easily feel better than Post Oak. I know we all love Architecture on here but the most beautifully frosted cake may still taste like crap.

Maybe you don't like Post Oak, but it's NOT crap. However, your over-dramatic opinion post is crap.

Concerning the Blvd project if it is executed as planned and including the Post oak line then yeah. Otherwise the buildings alone does not justify calling it The best BLVD.
