I live just outside the HD in the SW corner of Heights proper.  There is a builder who recently purchased a lot on our street that is deed restricted.  I am concerned the builder is go to split this property and combine it with a lot next to it he owns as well.  The lot 2nd lot is not deed restricted.  Per the Heights Association (link below), the COH does not enforce these restrictions.  If the builder does split the lot, what recourse is there and what is the proper channel to go through to report him?

If they split the lot, they will have to go before the City planning commission to get a replat.  Watch for the big white sign with black lettering on the property and watch the agenda here:  http://ataps1.pd.ci.houston.tx.us/DRC/PC+Meeting+Calendar.nsf.  Contact the planning commission well in advance of the hearing and let them know about the deed restrictions.  The planning commission should shut them down if the replat violates existing deed restrictions.  Otherwise, you have to go to court to enforce the deed restrictions as there is no HOA with authority to enforce them.
