1600 block of Vermont in Montrose. New construction. Hard to understand how crazy stuff like this happens.

Builder placed slab around 6" from neighbors fence. Sheathing was installed working mostly from the inside (looks like Zip System green coated OSB) and siding installed as possible. Note that OSB has not been taped as per manufacturer instructions. Conditions shown in photo have not changed much in many weeks. 2x4 temporary cleats are turning gray. Apparently there is some dispute about location of lot line. Dog-walker scuttlebut is that neighbor is not being very cooperative. Stay tuned.

Duh lesson: don't pour concrete until you have your lot line established!

Yeah the old duplex had a very narrow "driveway". Maybe a miata would have fit. The fence was there for many years. All of this is not rocket science. The lots there are 50x100 and there are plenty of iron rods to find. Builder screwed up, IMHO.

End of June update on the 1600 block Vermont St lot lines: nothing's happened to the unfinished exteriors. Builder Brogan claims they are going to go bankrupt if they can't finish and sell. Court denied builder a TRO. Judge apparently is not buying builder's claims.

The two units are no longer on HAR.com and sale signs are gone.

Stay tuned.

Good news! I am so tired of, well it's built so it stays! Too bad Brogan, you should have thought of that before impingeing on your neighbor.

That's freaking stupid of the builder! Isn't the first thing you do when you buy a lot is get a survey done with the set backs? Crazy!

something is odd, you CAN NOT get city aproved plans without a city aproved site plan/survey, and you CAN NOT pass a foundation inspection without city aproval which requres soils reports and a foundation survey to check location of home on property.

something is very strange here if they got that far and are in the worng place.

OK the problem has been resolved. Builder dropped suit against neighbor and work has begun to finish the siding. I guess the terms of the settlement would be confidential.

Case closed.

Just keep us posted, if you can on what happens from what you can tell.

Well, it has been resolved. At least this deal. Siding is going up.

Now, there is a PREVIOUS lawsuit that is still simmering, from the PREVIOUS owner of the new-build lot, against the neighbor, for messing up her sale to another builder who bailed after a PREVIOUS lot line situation could not be resolved. That case is set for trial in December 2009. Harris Co district courts 200824893.

The fun never ends.........

They took the fence(s) down. Upper areas I guess they do off ladders.

Next problem: roof runoff dripline on the west side is right at the fence line. Will builder put in gutter?

How the heck did they put on the siding? Even if the neighbor was the one over the property line, that's one really stupid builder.
