  1. Before you purchase a Tremont home, be sure and do some research. If you google Tremont Homes you'll find a lot of negative press....they've been kicked out of Houston's BBB and were named "Contractor from Hell" by People Magazine.
  2. What legal recourse does a homeowner have against a Title Company who filed forged and changed documents after my closing. After 4 months of trying to obtain my closing docs from Texas American Title for my Tremont Tower Condo Unit, finally received them. Why the delay I ask? I found 2 forgeries of my signature in my closing docs. So much for Homeland Security. When you can forge someone's name on the Patriot Act Data Collection/ Real identity verification. My real signature is on the bottom...The spelled my last name with an "N", not an "M", etc. But not bad, wonder how many other times Texas American has forged a signature? What legal recourse do I have? Also, I found a huge variance from the filed HUD statement vs the one I received at closing. I have put two separate documents on top of each other. The set filed says Wilshire received $17,728.09. The set I received on closing 7/30/04 says Wilshire received only $9,200.00.
  3. Condos are not covered in TRCC either. I purchased a new condo in Houston where I immediately discovered mold and got sick after moving in. Today, my condo remains uninhabitable, I have since moved out, and remain homeless. The Governor and I both thought TRCC could help me in my condo troubles, but we were both wrong. It took six months for me to find out. Governor Perry suggested in a letter that I seek TRCCs help on getting my condo fixed. He provided me with the contact info for TRCC, the address to write them as if all my condo troubles would be solved. So I did. Months later, TRCC responded: Sorry, but our agency can't help you, TRCC doesn't include condos only 'free standing homes'. A condo is not a home. Our own politicians do not know this, they don't even understand TRCC. Perry seems no sympathy to understand the lack of home owner's protection within a state agency he created nor which types of homes it even includes.
  4. Red, Thanks for the advice. I did receive a copy at closing (but not its entirety). When I compared my copies to the property records filed at the County Clerk's office, there were significant variations in the numbers. Enough to raise a red flag for mortgage fraud. The entire stack of original docs are key to a winnable mortgage fraud case. Coincidence now my file has gone MIA... Is there anything else I can do? My Mortgage Company: First Texas Residential has failed to return my calls, certified letters, and faxes. My broker, Doug Brown, has been investigated and put on notice from Texas Savings and Loan Dept. Tremont has failed to return my calls, letters, etc. too.. no suprise there. Sounds like a conspiracy theory, I tell you the whole thing is bizarre...
  5. My home has not foreclosed (even after 1 year 1 month of not paying on it). I have been needing the original closing docs for a potential mortgage fraud case against the lender/builder. But, what happens when a Title Company loses your original closing documents? What recourse do I have as an owner? After requesting a copy of my closing docs from First American Title four months ago, their auditing department finally called yesterday to admit: they have lost my original paperwork. Yes-all my closing docs. They don't even have back up copies. Robin Nelson, Auditing, stated 99.99% of the time this doesn't happen, it must just be human error and misfiled. Oh, just oops..like that ALL my paperwork has disappared. Sounds bizarre... You may call Robin yourself (713) 988-9999- (I couldn't believe it either). I have filed a complaint with the Texas Dept of Insurance...what else can I do?

  7. I can think of 5 builders not members of the BBB: Juliet Homes, Tremont, Centex, Pulte, and David Weekley. Construction agency doesn't help consumers Comptroller says commission a roadblock instead of a resource. By Jason Embry AMERICAN-STATESMAN STAFF Tuesday, January 24, 2006 A state agency that is supposed to help homeowners and builders resolve disputes is a toothless, time-consuming barrier for consumers and should be shut down, Comptroller Carole Keeton Strayhorn said Monday. In a report requested by a legislator, Strayhorn said the Texas Residential Construction Commission does not resolve conflicts between the two parties because it cannot force builders to make repairs. Carole Keeton Strayhorn Says Texas Residential Construction Commission should be shut down. "This agency imposes costly and bureaucratic roadblocks for homeowners left out in the cold by shabby construction and a commission dominated by builders," Strayhorn said. The agency's commissioners were appointed by Gov. Rick Perry, whom Strayhorn, running as an independent, hopes to defeat in November's gubernatorial election. Agency Executive Director Duane Waddill said newly created rules will allow the commission to revoke the registrations of recalcitrant builders. "Her review is based on the old process," Waddill said, although he added that he looks forward to using the report to improve the agency. The Legislature created the commission in 2003, in part at the request of builders hoping to reduce lawsuits. A homeowner who finds defects after construction that are not fixed within 30 days can ask the commission to appoint an inspector to check the home. A homeowner requesting that review must pay a $250 fee, which is reimbursed if the inspector's report supports the homeowner's allegations. The inspector then issues a report that cannot require repairs but can be used later in arbitration or lawsuits. State Rep. Todd Smith, R-Euless, requested Strayhorn's report. House State Affairs Committee Chairman David Swinford, R-Dumas, has said Strayhorn was overstepping her bounds and asked Attorney General Greg Abbott in December whether Strayhorn had authority to make the report. Abbott has not ruled on the matter. Strayhorn surveyed the 257 people who had used the resolution process through October and received 102 responses. She said 86 percent of respondents said builders failed to fix construction defects in their homes after going through the resolution process. She also said that 45 percent reported being unsatisfied or very unsatisfied with the way the commission handled the process and that 49 percent said they were satisfied or very satisfied.   11. Running for political office, opening a business, and completing city records with a fake address is much more serious than using a wrong address for junk mail. I'm sure 900 Bagby is not the address listed on your Driver's License. At yesterday's City Council Agenda meeting (reruns are still playing on tv), there is much discussion on the Tremont/ bad building issues. Tremont (University Developments) got a $500,000 city contract Pulled (Not tagged, completely pulled off the city agenda). Bill White seemed mad and upset, with mention of Norman Chapa pleading guilty to federal charges and the fact they were fired from previous city jobs because of bad building. City Council and Mayor White became aware of the many addresses Tremont has used, with Norman Chapa as their acting agent, and in some cases a "Director" . Regarding fake addresses, City Council was confused how another Tremont associate Hilda Delgado had so many addresses. "Hilda Delgado" lived at Tremont Tower 3311 Yupon Street while she was also President of University Developments. According to HCAD, Hilda Delgado does not own a home at 3311 Yupon Street. "Who is Hilda Delgado? I'd like to meet her. She seems to own property all over Houston" remarked City Council woman Ada Edwards. University Developments had been receiving substantial city contracts for low-income housing, such as Willowbrook, yet had a track record of bad building (see Houston Chronicle article regarding them being fired from Memorial Police Station due to mold, 9 mths behind schedule). Seems like the Mayor is finally cleaning up the political mess of bad building and those who falsify addresses. Kudos to the Mayor and Ada Edwards!
  12. Norman Chapa -who last year plead guilty to fraud charges - will be indicted in federal court this Jan. 20th at 10:30AM in Judge Ellison's court. Chapa has been listed as Jorge Casimiro's registered agent for dozens of businesses at 2323 Shepherd Street, coincidentally, Orlando Sanchez's office address. Jorge Casimiro is President, CEO of Stature Construction, University Developments, Tremont Homes, Tremont Tower, Tremont Construction, Simon, and Carlisle Homes. Sanchez, Casimiro, Chapa? Three peas in a pod? Why is Sanchez now running for county Treasurer with a rap sheet of potential friends being indicted on federal charges and pleading guilty?   13. Chapa's sentencing is now Jan. 20th at 10:30AM in Judge Ellison's court. As Chapa has plead guilty, he most likely will serve time... any other thoughts?
